These Terms of Service (the “Terms”) govern your access to and use of the Nutrplan application and website (the “Service”), which is operated by Nutrplan (“Nutrplan”, “we”, “us”). By creating an account or using the Service you agree to these Terms.
1. Wellness tool, not a medical device
Nutrplan is a general wellness and educational tool. It is not a medical device, is not intended to diagnose, treat, cure, or prevent any disease, and is not a substitute for professional medical advice, diagnosis, or treatment. Meal suggestions and clinical reasoning shown in the app are generated by artificial intelligence based on the information you provide and may be incomplete, inaccurate, or unsuitable for your situation.
Always consult a qualified healthcare provider before changing your diet, starting or stopping any medication or supplement, or acting on anything the Service suggests, especially if you have a medical condition, are pregnant or nursing, or take prescription medications. In an emergency call your local emergency number.
2. Eligibility & accounts
You must be at least 18 years old to use the Service. You are responsible for the information you enter, for keeping your account credentials confidential, and for all activity on your account. Provide accurate information and keep it up to date.
3. Acceptable use
You agree not to: (a) use the Service for diagnosis, treatment, or any clinical decision-making without independent professional review; (b) submit information about another person without their consent; (c) attempt to reverse-engineer, scrape, or interfere with the Service; (d) use the Service to violate any law or the rights of others.
4. AI-generated content
Meal plans, recipes, and clinical reasoning are produced by large language models. Output may contain errors, outdated information, or content that is not appropriate for you. You are solely responsible for evaluating any output before relying on it.
5. Your content
You retain ownership of the health information and other content you submit. You grant Nutrplan a limited license to process that content solely to provide the Service to you (including transmitting it to the AI providers we use to generate your plans).
6. Termination & deletion
You may delete your account and associated data at any time from your Profile page. We may suspend or terminate accounts that violate these Terms.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NUTRPLAN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEDICALLY ACCURATE.
8. Limitation of liability
To the maximum extent permitted by law, Nutrplan and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or health outcomes, arising from your use of the Service.
9. Governing law
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Illinois for any dispute arising out of or relating to these Terms or the Service.
10. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.
